Hi.
I would like to know what would be the outcome in the following situation, and who would be prosecuted in such a case.
I see regularly on the TV channel Bravo (Road Wars), young drivers being pulled over and then to have the officer stick his or her nose in the vehicle to analyse the scent. They detect a smell of cannabis in the car and search all passengers but to no avail. Further searching uncovers a small bag of top grade marijuana underneath passenger seat. That bag MAY have been there for days/weeks/months without the driver known....it is a possibility.
The officer then states "Phew...that stinks....right, whoever's this is, own up now and we'll deal with it at the roadside.....otherwise your all coming down the station!"
Now, if the driver denies ownership, as do the other passengers, how can you possibly have the right to take innocent parties to the nick?
On another note.......would a court of law not find it a hard task proving it belonged to a certain individual?
Any information you can give will most certainly enhance my viewing of Road Wars.
