Pushing Moped While Drunk

Hi,

On saturday my mate was drunk but cause he never wanted to leave his scooter outside where he was he pushed it to his house. if he had been stopped by the police would he have been charged with drink driving ??

the engine was not on but he was in possesion of the keys

Technically speaking, he could have been constued to have been 'driving' on the basis that he was in control of the speed and direction of the vehicle, even though it was only being pushed. If he had lost his balance and the machine fell against a parked car, damaging it, for example, then a vehicle accident would have occurred.
