I while ago I asked you a few quastions about an icident when I was stopped for speeding.

I eventually got my letter of complaint throught the door and I filled in my explanation and sent it back with my licence as requested.

I have since found out some information which obviously at the time I did not know.... this is that according to the Road Traffic Offenders Act if I do not receive my "letter of complaint" which they call it is Scotland within 14 days of me being stopped I cannot be done for it.

As it was almost 4 months from being stopped to me receiving my letter and this was the one and only letter I received how do I go about submitting this as my court date was 10 days ago, also I want to know if this is the case in every speediing case or are there exceptions?

The 14 day rule is flexible- it can take longer to contact the driver due to unforseen circumstances. These can vary from address checks, information being invalid on the Police national computer or delays in delivery.

If in doubt, or if you think you have a case, i'd advise you to consult your solicitor and bring it to the attention of the court.
